1. General

The software, samples and documentation are licensed, not sold, to you by .theprodukkt GmbH for use only under the terms of this License. .theprodukkt reserves all rights not expressly granted to you.
The terms of this License will govern any software upgrades provided by .theprodukkt or its subsidaries that replace and/or supplement the original Software product, unless such upgrade is accompanied by a separate license in which case the terms of that license will govern.

2. Permitted License Uses and Restrictions

This License allows you to install and use .werkkzeug3 Texture Edition.
Except as and only to the extent expressly permitted in this License or by applicable law, you may not copy, decompile, reverse engineer, disassemble, modify, or create derivative works of .werkkzeug3 Texture Edition or any part thereof. You may not decompile, reverse engineer or disassemble any exported or otherwise by .werkkzeug3 Texture Edition generated files.

3. Distribution

You may not rent, lease, lend or sublicense .werkkzeug3 Texture Edition, or any parts or samples provided with the software.

4. Consent to Use of Data

You agree that .theprodukkt GmbH and its subsidiaries may collect and use your personal data, as submitted by registering. You data will not be given to any third party unless forced by law or court order.

5. Usage of generated Files

Files generated (exported) using .werkkzeug3 Texture Edition's "Export to BMP" function may be used without any restrictions for all legal purposes.
Files generated (exported) using .werkkzeug3 Texture Edition's "Export" function (binary files) may only be used with the corresponding texture generation library, provided exclusively by .theprodukkt GmbH.

6. Termination

This License is effective until terminated. Your rights under this License will terminate automatically without notice from .theprodukkt GmbH, if you fail to comply with any term(s) of this License. Upon the termination of this License, you shall cease all use of .werkkzeug3 Texture Edition and destroy all copies, full or partial, of it.

7. Disclaimer of Warranties

.werkkzeug3 Texture Edition is provided "as is", without any warranty of any kind.
You agree that the use of .werkkzeug3 Texture Edtion is at your sole risk. .theprodukkt GmbH is not liable for any damages, injuries, data losses or other effects, caused by the software or any generated data.

8. Limitation of Liability

If for any legal reason, .theprodukkt is found liable for any damages, .theprodukkt GmbH is not liable for more than the price of the software or 50 Euro, whatever is the higher amount. The foregoing limitations will apply even if the above stated remedy fails of its essential purpose.

9. Controlling Law and Severability

This License will be governed by and construed in accordance with the laws of Germany.
This License shall not be governed by the United Nations Convention on Contracts for the International Sale of Goods, the application of which is expressly excluded.
If for any reason a court of competent jurisdiction finds any provision, or portion thereof, to be unenforceable, the remainder of this License shall continue in full force and effect.
Place of General Jurisdiction is Hamburg, Germany.
